For non-Dutch speaking managers or HR-professionals working in an international company In this one-day workshop of max. 6 participants we focus on Western European Countries, the US and an additional country of your personal choice. As an HR-professional or manager working in an international company with global and/or regional presence you wish to gain expertise in the Labour laws of multiple countries. You may have an understanding of employment law and HR of one country and also want to be knowledgeable about other countries you have responsibility for. You would like to not only understand the “Law of the Land” of different countries but also understand the context, dynamics, sensitivities and priorities of Industrial Relations and Employee Relations of those countries   While you are operating from your regional headquarters or global headquarters: what are the questions to ask your advisors, inside or outside your company - and how do you appreciate and trust the information available with you? This workshop, with its overview of the employment laws of a number of countries that are relevant for yourself and the other participants, equips you to provide the right (HR) leadership and take prudent decisions related to people and management. For non-Dutch speaking managers or HR-professionals working in an international company based in the Netherlands In this workshop we discuss employment law frameworks and practical tips in light of designing ‘improvement processes’ in the event of alleged non-performance and undesirable behaviour, for example based on a code of conduct, warnings and intervention.  We refer to contemporary notions of what it takes to be a good employer and look at good employment practices. We will discuss approaches and instruments needed for file building. And, of course, we also pay attention to the prevention of non-performance and undesirable behaviour. We do this in a way that suits you, your values, ambitions and challenges – and those of your organisation. As an included service, we offer each individual participant of any first of our workshops a one hour personal intake & advice (in person or online). Topics The following topics will be covered in this workshop: Dealing with perceived non-performance. How should you deal with an employee who always refuses to wear protective equipment when performing his job, or with an employee who is regularly late? How should you act towards employees who do not comply with the procedural rules when reporting sick, or who execute their work so carelessly that the company suffers damages? What should you do with an employee who can no longer keep up with his work? How much effort do you have to make as an employer to keep them employed? What requirements must an improvement project meet? Dealing with undesirable behaviour. How do you prevent undesirable behaviour by paying attention to core values and codes of conduct? How do you translate a code of conduct into warnings and interventions, including suspension and immediate dismissal? What are the employment law frameworks and practical tips for investigating and handling complaints? File building remains an important point of attention. Without a good file structure, there will be no termination of the employment contract with an employee who continues to malfunction despite many conversations. Do you still have to try to keep them employed, or can you suffice with striving for dismissal? What are the legal requirements for a comprehensive personnel file and how do you deal with this in practice? Bottlenecks in dismissal & filing. What ground for dismissal forms the basis of a non-performance file? And how do you provide the correct substantiation for that ground? When is the file ready for dismissal? How can it be demonstrated that the employee has been offered an improvement program, that a suitable training offer has been made and that there are no options for transfer? Of course, we also pay attention to: how do you conduct a continuous and motivating conversation about the performance and behaviour of employees – and yourself? What is the relationship between the wishes and requirements in the field of development, training, and improvement processes, in relation to the ambitions and goal of the organization? RESULT At the end of this workshop, with a maximum of eight participants, in which we also work with your own cases: You will have knowledge of employment law frameworks for dealing with alleged non-performance and undesirable behaviour, based on contemporary notions of what it takes to be a good employer and good employment practices. You know how to deal with situations in which discontinuation of the employment relationship seems inevitable. For non-Dutch speaking managers or HR-professionals working in an international company based in the Netherlands Due to recent developments, financial pressure or for other business reasons, many organizations feel compelled to reorganize. That is a complex job for all involved: management, HR and employees. You have to deal with the rules of Dutch labour law and a possibly applicable collective agreement, which are often "at odds" with contemporary approaches - and sometimes even go square against them. What has been built up over the years in terms of working from core values, increasing self-management and dialogue with and between all layers in the organization often threatens to be canceled out with top-down reorganization. After all, we now know that the most important source of resistance is the change approach itself. Employees are loyal to the past and not to the future they do not know, how do you deal with that as a manager? Content of the workshop Organizational change can indeed be managed differently than the traditional ways: It can be effective, development-oriented, based on the core values of the organization and also within the legal frameworks. While inspiring and involving the "the shop floor" in the planning along with the rest of the management teams. So, it can be Top Down and Bottom-Up Change. A change not primarily from necessity, but from a deeply felt wish to align more with what is really playing and what is really needed. Topics in this workshop: Challenges, facts and opportunities in a reorganization, merger or takeover. What are the legal preconditions in the Netherlands and how can you effectively and carefully design the required processes within them, while the (new) organizational philosophy remains leading? Overview of change approaches, traditional and contemporary. With their advantages and disadvantages, implications for and relationship to HR policy and Dutch employment law frameworks that result from the law, collective labour agreement or the own employment conditions regulation. Are we switching to a new form of organization in a "big bang", or phased, step-by-step experimentation, department by department, team by team? How do you develop a vision for the future, a (re) organization plan and a social plan as "growth documents" in collaboration with employees and with the required internal stakeholders such as Works Council, Trade Unions and any external "stakeholders"? With room for the individuality, role and (legal) duties of each party. Examples from practice, from various sectors. How does a social plan fit in with what is really needed? Where and when do you consult with all parties involved and how do you organize and direct the interaction? What is needed? Have employees give shape to staff reduction exercises, is that also possible? How do you measure the effects of your interventions - and how do you evaluate progress?
